G. REFUND POLICY.

Due to our products being downloads and not returnable, we uphold a no refund policy.

L. INDEMNITY.

You agree to defend, indemnify and hold harmless SpankPass, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from accessing SpankPass, using SpankPass, downloading a product from SpankPass or a 3rd Party vendor, damage caused to a 3rd party from studio submitted products, you or a 3rd party violating the Terms of Service, your violation of SpankPass or 3rd party copyright, property or privacy rights, accessing the site by a minor, or providing access to the site or content to a minor.

You affirm that you are more than 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

These Terms of Service, together with the PRIVACY NOTICE and any other legal notices published by SpankPass on the Website, shall constitute the entire agreement between you and SpankPass concerning the Website. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and SpankPass's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. YOU AND SPANKPASS AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITE MUST COMMENCE WITHIN 6 MONTHS AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

M. JURISDICTION AND VENUE.

This site is controlled and operated by SpankPass and its representatives from their offices in Westminster, Colorado. We make no representation that the materials available on this site are appropriate or available for use in other locations, and access to them from jurisdictions where their contents are illegal is prohibited. HJM LLC (“Operator”), registered / established at 13611 E 104TH AVE UNIT 800 301 , Commerce City, CO 80022, operating SpankPass, is solely responsible for all content, advertising, promotions, and materials made available on this Website. No other person or entity (including content creators, models, or studios) is responsible for Website content in place of Operator. Operator represents that it owns or has the legal right and authority to use, display, and distribute all content on this Website, including text, graphics, photos, videos, and other media.

All persons depicted in content on this Website were at least 18 years of age at the time of production. Where the word “teen” or similar descriptors appear in titles or marketing, they refer only to performers who were 18 or 19 years of age at the time of production. Operator maintains age-verification and record-keeping documentation as required by applicable law, including 18 U.S.C. § 2257 and related regulations where applicable. Operator does not knowingly publish illegal content, including content involving minors, non-consensual material, or other unlawful material.

Unless a plan is clearly marked as a one-time (non-recurring) purchase, memberships are recurring: after the initial term (and after any disclosed trial or promotional period ends), your payment method will be charged the disclosed membership amount on the disclosed interval until you cancel.

Payment processing for card transactions is handled by authorized third-party billing merchants. Verotel is a billing partner of Operator. Depending on the checkout option you select, your payment may be processed by:

Operator does not store full payment card numbers on this Website; card data is collected and processed by the billing merchant on its secure checkout pages. Refunds are governed by Section G (Refund Policy) and by the policies of the applicable billing merchant.

R. CANCELLATION POLICY.

You may cancel a recurring membership at any time so that subsequent renewal transactions do not occur. Cancellation stops future renewals; it does not automatically refund amounts already charged for the current paid period unless required by law or by the billing merchant’s refund policy.

To cancel, use one of the following methods:

a) Contact the billing merchant that processed your signup (Verotel at www.vtsup.com / livesupport@verotel.com, or CCBill at support.ccbill.com) and request cancellation of the recurring subscription;

b) Use any cancellation or account tools made available in your member account area on this Website, if offered; or

c) Contact Operator via the Contact Us page or at webmaster@hjmsites.com and request assistance cancelling your membership.

After cancellation is processed by the billing merchant, no further automatic renewal charges should be made for that subscription. Access typically continues through the end of the period already paid for.

S. ANTI-SLAVERY AND HUMAN TRAFFICKING POLICY.

Operator prohibits the use of this Website in any way that promotes or facilitates human trafficking, sex trafficking, modern slavery, forced labor, or abuse. Operator does not knowingly engage suppliers, content providers, or partners involved in such activities.
